It should be the case in Canada, but I think there is a lot of leeway. Sometimes no inquest is held in a case like this where there is question about what happened.
If it really was an accident, they should welcome an inquest and be glad to have all the evidence independently examined. With out the inquest there will always be a shadow of a doubt.

Even if it was an accident there would be recommendations that the drivers be more careful when there are people on the road.
